Heard on Cr.M.P. for grant of leave to appeal against the judgment dated 20-02-2015 passed by Additional Judge to the Court of Additional Sessions Judge, Ramanujganj, District Surguja (Ambikapur), C.G. whereby and whereunder the trial Court acquitted the respondent for the charges framed against him. For the purposes of leave to appeal, copy of the judgment and other annexed documents are hereby perused.

In view of this Court, this is a fit case where leave to appeal be granted.

Consequently, the instant Cr.M.P. is allowed and the leave to appeal is granted.

Registry is directed to list the matter under the head of Acquittal Appeal.

Also heard on motion.

On due consideration, the instant acquittal appeal is admitted for consideration.

Registry is directed to call for the record of the trial Court through usual mode and fax mode.

The appellant is directed to pay P.F. within 7 days from now.

Let notice be issued to the respondent through usual mode and registered mode, returnable within 4 weeks.

Registry is directed to list the matter immediately after notice to the respondent is complete for further hearing.
