Ms. Sunita Jain, Govt. Advocate for the State. Heard on I.A.No.1, Application for granted permission to argue the bail application to the new counsel.

Since it has been alleged that NOC has not been given by the earlier counsel though it was asked for, which has been supported by an affidavit and the applicant thereafter has engaged Mr. Deepak Jain, he is to argue this case.

Heard Learned counsel appearing for the applicant, after arguing some time, seeks permission of this Court to withdraw the instant bail application filed under Section 439 of Cr.P.C. with liberty to repeat the same after examination of the prosecutrix.

It is ordered, as prayed for.

Accordingly, the bail application is dismissed as withdrawn with the aforesaid liberty.
