Hon'ble The Vacation Judge Order On Board 18/05/2015
1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 112/2015 registered in police station City Kotwali, district Dhamtari, Chhattisgarh for offence punishable under Section 279 of the Indian Penal Code.
2. The applicant has allegedly drove the truck/dumper in a rash and negligent manner, ran over the road divider and damaged two electric poles causing loss of public property to the extent of Rs. 79,000/-.
3. Learned counsel for the applicant would submit that the offence is triable by the Judicial Magistrate First Class, the applicant is in jail since 25.4.2015 and the charge sheet has already been filed and therefore the applicant may be released on bail.
4. Learned State counsel would oppose the bail application.
5. Considering the facts and circumstances of the case and the fact that the applicant is in jail since 25.4.2015, this Court is inclined to release him on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs. 25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
