The Petitioner moved this Court with the following prayers: "(i) That, this Hon'ble Court may kindly be pleased to issue an appropriate writ/order/direction to the Respondent more particularly one in the nature of Writ of Mandamus thereby directing the Respondent No.1 to allow the petitioner to participate in the tender process by accepting tender form and documents submitted by petitioner alongwith EMD amount.

(ii) That, any other order/relief which this Hon'ble Court may deem fit, proper and just in the facts and circumstances of the present case may also kindly be awarded to the petitioner in the ends of justice & equity. (iii) That, the cost of the petition may kindly also be awarded to the petitioner."

Heard the learned counsel appearing for the Petitioner as well as the learned standing counsel appearing for the Respondent-Corporation. 3.

During the course of submission, it is brought to the notice of this Court by the learned standing counsel for the Respondent-Corporation that the tender which is under challenge in this writ petition has already been cancelled for want of competitive bidders. It is stated that the fresh proceedings would be initiated and pursued in accordance with law and it is open to the Petitioner also to participate in the said proceedings, if qualified in all respects. The said submission is recorded.
