Hon'ble Shri Justice P. Sam Koshy Order on Board 09.07.2018 1.

The challenge in the present writ petition is against the order dated 18.05.2018 whereby the respondent No.6 has been given employment inspite of the petitioner having been more qualified and scored more marks.

The grievance of the petitioner is such which is redressable by way of an appeal to the Collector under Section 91 of the Panchayat Raj

Adhiniyam as also the provisions of Chhattisgarh Panchayats (Appeal & Revision) Rules, 1995.

Given the facts and circumstances of the case and considering the fact that the petitioner has efficacious statutory alternative remedy of filing of appeal before the Collector, this court is not inclined to entertain the petition at this juncture.

Accordingly, reserving right of the petitioner to approach the Collector at the earliest along with an application for interim relief, the present petition stands disposed of and the Collector in turn shall decide the objection/appeal of the petitioner at the earliest in accordance with rules governing the field after due scrutiny of all the relevant documents.
