Heard It is submitted that the appellant has already suffered the entire jail sentence and the same is also evident from the conviction order dated 07.11.2012 wherein the appellant has been shown to be in jail from 09.02.2012 and the sentence awarded was of 5 years and a fine of Rs.1000/-, in absence of payment of fine, further 1 month S.I. was ordered for.

Perusal of the order itself shows that the entire jail sentence has been suffered by the appellant. In view of this, learned counsel for the appellant do not want to prosecute this appeal on merit, at this stage. Consequently, the appeal is dismissed as withdrawn.
