For Non-Applicant : Shri Ravish Verma, Govt. Advocate. Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 09/12/2020 :

1. The applicant has preferred this application for grant of anticipatory bail as he apprehends his arrest in connection with Crime No.215/2020, registered at Police Station Surajpur, District Surajpur for offence punishable under Section 376 (2)(N) & 506 of the IPC.

2. The applicant and the prosecutrix became friendly in the year 2014 and thereafter the applicant started sexually exploiting her on the pretext of marriage from February, 2016 onwards. During this relationship, she was aborted twice and the applicant used to threaten the prosecutrix of making viral her naked photographs/videos.

3. Learned counsel for the applicant would submit that the applicant and the prosecutrix were known to each other and the allegations are false and concocted. Since the prosecutrix used to demand money from

MCRCA No. 1281 of 2020 the applicant which was paid some times but later on the applicant refused to part with the money, the instant false report has been filed.

4. On the other hand, learned State Counsel would oppose the prayer for grant of anticipatory bail.

5. Having seen the case diary, prima facie, the allegations appear to be serious in nature. Therefore, considering the manner in which the offence has allegedly been committed, I am not inclined to extend the benefit of anticipatory bail to the applicant. Accordingly, the Application is rejected.
