1. The applicant has preferred First Bail application u/s 439 of Cr.P.C. for grant of regular bail as he is arrested on 10.04.2020 in connection with Crime No. 57/2020 registered at Police Station Rajpur, District Balrampur, Ramanujganj C.G. for offence punishable under sections 294, 506, 324, 307 of IPC.

2. As per the prosecution case on 09.04.2020 on a trivial dispute when the injured Prasad Ram was talking to his family, it was objected by the applicant and the applicant went to the house and came out with a knife and thereafter assaulted the father of the complainant.

3. Learned counsel for the applicant would submit that the injured was initially admitted to Rajpur thereafter on the same day he was transferred to Ambikapur and was discharged and injury was not fatal, therefore, the applicant may be enlarged on bail.

4. Per contra, learned State counsel opposes the prayer for grant of bail and submits that there are 2 injuries one on hand and another on abdomen.

5. Perused the medical report which shows that one injury is at abdomen and the applicant came back with a knife and assaulted. Considering the medical report and the statement of the witness, I am not inclined to release the applicant on bail.
