This appeal by the accused/appellant under Section 14-A (ii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 is directed against the order dated 06/07/2021 passed by the Special Session Judge (Atrocities) Ramanujganj, District Balrampur- Ramanujganj C.G., rejecting the bail application of the appellant filed under Section 439 Cr.P.C. who is in jail since 21/03/2021 in connection with Crime No. 9/2021 for the offence punishable under Sections 376 (2) (n) and 450 of the Indian Penal Code and Section 3(2) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act registered at Police Station AJAK, Balrampur, District Balrampur-Ramanujganj (C.G.)

2. Notice on the prosecutrix/victim has been served, but she is

present nor there is any representation on her behalf. 3.

Counsel for the appellant seeks permission to withdraw this appeal with liberty to file afresh, if the occasion so arises. 4.

Permission is granted. The appeal is dismissed as withdrawn with the liberty prayed for.
