Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 09/09/2021

1. This is repeat bail application. Earlier application was rejected on merits.

2. Learned counsel for the applicant would submit that repeat application has been filed because now, prosecutrix has been examined and her evidence before the Court that she was subjected to rape is not reliable.

3. Appreciation of evidence is to be done by learned Court below and not by this Court. Present is not a fit case for grant of bail.

4. The bail application is accordingly rejected.

5. However, the trial Court is directed to expedite the trial and conclude the same as early as possible without granting unnecessary adjournment to any of the parties.
