Shri Justice P. Sam Koshy Order on Board 09.07.2019

1. Counsel appearing for the petitioner submits that the default pointed out by the Registry has since been removed.

2. Limited grievance of the petitioner in the instant case is that his date of appointment in the Gradation List, published in the year 2018, wrongly shows the date of appointment as 16.08.2010, whereas the petitioner has been initially appointed as Shiksha Karmi Grade-I on 22.07.1998. Thus, the petitioner seems to have lost seniority of about 12 years.

3. Given the limited dispute that the petitioner has and the fact that the petitioner has made representation to the authorities concerned.

4. Let the Respondent No. 02 and 03 get the original service record of the petitioner and verify the date of appointment and grant proper seniority to the petitioner from the date of his initial appointment i.e., 22.07.1998.

5. Let the Respondent No. 02 and 03 take appropriate decision at the earliest, preferably within a period of 4 months from the date of receipt of copy of this Order. Needless to mention that since the petitioner now stands absorbed in the Education Department. The direction is given to the Respondent No. 02 and 03 to contact the concerned authority in the Panchayat Department also if required to verify the original date of appointment of the petitioner.

6. With the aforesaid observations, the present Writ Petition stands disposed off.
