1. This is the third bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 144/2020 registered at Police StationJashpur, District Jashpur (C.G.) for the offence punishable under Sections 307, 120B, 34 of the Indian Penal Code.

2. The first bail application was dismissed on 19.01.2021 and second bail application was dismissed on 22.07.2021.

3. As per the prosecution case, there was a land dispute between the complainant Dashrath Prasad Jaiswal and the applicant's party. It is alleged that on 14.07.2020 while Dashrath Prasad was on his morning walk at 4 a.m., the applicant along with other accused assaulted him with hands and

fists.

4. Learned counsel for the applicant submits that the applicant is in jail since 15.07.2020 therefore, the present applicant may be released on bail.

5. Learned State counsel opposes the argument for grant of bail.

6. Considering the fact that only one month has passed after rejection of the second bail application, I do not find any change of circumstances to entertain the third bail application.

7. Accordingly, the third bail application filed under Section 439 of Cr.P.C. is rejected.
