1. The grievance of petitioner in the present writ petition seems to be the inaction on the part of the respondents in not releasing the post retiral dues payable to petitioner pertaining to his GPF and GIS amount.

2. According to petitioner, he stood retired from the Cooperative Department of the respondent State in the year 2017. Though the petitioner has been paid all other dues that he was entitled for, the respondents for no reason have retained GPF and GIS amount.

According to petitioner, there is no order passed by the respondent authorities which could entail withholding of the releasing of amount under GPF and GIS.

3. Learned counsel appearing for the petitioner also referred to the correspondence made by the Additional Registrar to the Dy. Registrar to take appropriate steps for releasing the amount payable to the petitioner under GPF and GIS. The Additional Registrar vide its correspondence dated 02.06.2021 had directed the Dy. Registrar to settle the dues within 15 days. It is the contention of petitioner that in spite of more than 2 months having lapsed even till date the petitioner has not got any benefit under GPF and GIS.

4. Learned counsel appearing for respondent no.3 submits that since there is no intimation and correspondence made by the Department to the respondent no.3 in respect of GPF and GIS, no such further instruction could be issued from the Office of respondent no.3.

Given the said submissions by the counsel for the parties, the writ petition at this juncture stands disposed of directing the respondents 1 & 2 to ensure that the entire admissible dues under GPF and GIS payable to the petitioner be processed and released forthwith without any further delay unless the same has to be withheld for any of the statutory reasons governing the filed. Let the exercise be completed by the respondents 1 & 2 within a period of 45 days from the date of receipt of a copy of this order.
