The present Writ Petition has been filed by the petitioner against the refusal to grant compassionate appointment to the petitioner on the post of Assistant Teacher Panchayat on the ground that the petitioner has not been able to acquire minimum qualification i.e. required for the said post in spite of the petitioner being granted 3 years time.

At this juncture the counsel for the petitioner submits that, the petitioner may be considered for grant of compassionate appointment on a lower post

commensurate to the qualification which the petitioner has which is only 12th pass. The counsel for the petitioner submits that, the petitioner also is ready to accept the post like Peon etc. in the department. 3.

The State counsel considering the submissions made by the counsel for the petitioner fairly submits that, subject to the petitioner making a claim application in writing in this regard to the respondents No.2 & 3 within a period of 4 weeks from today the petitioner the respondents No.2 & 3 shall '

consider the case of the petitioner for grant of compassionate appointment on a lower post commensurate to the qualification which she has, with which the petitioner would be able to sustain the family. 4.

Thus it is directed that on an application being made by the petitioner within a period of 4 weeks , the respondents may further process the case of '

the petitioner within a further outer limit of 90 days from the date the petitioner makes a fresh claim application and pass a final order. 5.
