In view of the fact that 42 kg of Ganja has been recovered from the applicant and out of 14 witnesses, the prosecution has already examined 11 witnesses, this Court is not inclined to entertain this repeat bail application. Learned counsel would submit that despite the earlier order expediting trial, the same still remains pending, therefore, a fresh direction may be issued to the trial Court for early conclusion of the trial. He would submit that the Court was lying vacant for considerable time. The Registry has informed that the Special Judge (NDPS Act) has been notified by the State Government on 19.5.2015.

In view of the above, while rejecting the bail application, it is directed that the trial Court shall make all possible endeavour to conclude the trial at the earliest. Sd/- Judge (Prashant Kumar Mishra) Barve
