Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 31/08/2016 The transfer order is under challenge on the ground that the petitioner is being subjected to transfer for the first time after initial appointment made three years before. It is submitted that as per Clause 1 (1.3) of policy dated 03/06/2015, after completion of initial posting in scheduled area, a Government Servant is required to be posted outside the scheduled area. 2.

In view of submission made herein, it would be proper to direct the respondents to consider the case of the petitioner for posting to any other station outside the scheduled area as per Clause 1 (1.3). 3.

The petitioner has already preferred representation. The representation of the petitioner be decided within a period of three weeks and for a period of three

weeks, the petitioner shall not be compelled to join at the new place of posting provided no one has joined at the present place. 4.
