The transfer order is under challenge on the ground that the transfer order would be contrary to exigency of Government working in Agriculture Department in view of letter issued by the Secretary, Department of Agriculture that officer should not be disturbed during the agriculture period. The other ground is that in case, certain land acquisition cases pending before the Collector, Jagdalpur, the petitioner is required to attend proceedings and if it is posted at the new place, he will face serious difficulty in attending the proceeding.
-2The exigency of service is a matter for determination of the Government and not the employee. The other ground does not appear to cause any hardship to the petitioner because the place where the petitioner is now being transferred is hardly 50 km. away. Therefore, I am not inclined to interfere with the transfer order and the petition is accordingly dismissed.
