2. Learned counsel for the petitioner submits that the brother of the petitioner namely Late Vedprakash Ekka died in harness on 01.03.2012, the death certificate is filed as Annexure P/1. The petitioner and his mother were dependent on him and at the time of his death, the petitioner was minor. Thereafter, in the year 2013, when the petitioner became major, filed an

application for compassionate appointment before the respondent No. 3 (Block Medical Officer, Community Health Centre Batauli Distt. Surguja C.G.) by Annexure P/2. The deceased was working as Ward Boy in the Community Health Centre Batauli Distt. Surguja. The reference is made in the documents filed along with the petition and it is further submitted that after the due enquiry the Block Mecial Officer found the case of the petitioner in affirmative to appoint him on the compassionate ground however the order of appointment has not been issued. It is contended that therefore the petitioner had made repeated applications before the respondent No. 2 (Chief Medical Health Officer Ambikapur Distt. Surguja C.G.) who issue such orders of compassionate appointment however till date the same has not been issued therefore the representation of the petitioner which was lastly made i.e. on 13.07.2020 may be considered and directed to be decided within a reasonable time.

3. Perused the documents. One of the document placed in this petition shows that the case of the petitioner was considered for compassionate appointment which bears the seal and initial of Block Medical Officer. Considering the same, the petitioner is given liberty to file a fresh representation before the respondent No. 2 (Chief Medical Health Officer Ambikapur Distt. Surguja C.G.) within a period of three weeks along with the copy of this writ petition along with documents which are filed and

thereafter the respondent No. 2 shall decide the case of the petitioner for compassionate appointment within a further period of 90 days from the date of receipt of such representation.

4. With the aforesaid direction/ observation, the writ petition stands disposed of.
