This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 12.06.2020 in connection with Crime No.119/2020 registered at Police Station- Gariyaband for the offence punishable under Section 302, 201, 315, 120-B, 34 of Indian Penal Code.

As per the prosecution case, the applicant had administered poison to one Ku. Damini and had assaulted Bhupendra who were in love relation and thereafter killed them.

Learned counsel for the applicant submits that the applicant has been falsely implicated and there is no direct evidence available against the applicant, therefore, the applicant may be released on bail. 4.

Per contra, learned State counsel opposes the prayer for grant of bail. 5.

Perused the documents. On the memorandum of the applicant, the club was seized and death was caused because of the injury. Considering the nature

of evidence, I am not inclined to release the applicant on bail. Accordingly, the bail application filed under Section 439 of Cr.P.C. is rejected. Sd/- (Goutam Bhaduri) Judge Ashok
