Learned counsel for the petitioner submits that the petitioner had filed petition aggrieved by inaction of the respondents, whereby he was transferred showing on his own request.

In view of the aforesaid submission order dated 11.08.2016 passed in WPS No. 3675 of 2016 is hereby recalled and following is passed. 1.

"The ground of challenge against the transfer order is that even though the petitioner never made any application for transfer on his own request, impugned transfer order shows that he has been transferred on

his own request. The allegation made in the petition is serious.

Respondent No.1/State, though a responsible officer, shall get inquiry made in the matter and appropriate decision be taken in the matter. It is expected that the inquiry shall be completed within 30 days. 3.

For a period of 30 days, petitioner shall not be disturbed from his present place of posting.

With the said observation, the petition is disposed off."

MCC is accordingly disposed off.
