Learned counsel for the respondent submits that non-appearance of respondent on the earlier date of hearing, was merely accidental and not with any intention to avoid the Court's proceeding. It is submitted that on the last date of hearing, Vakalatnama was filed but the counsel could not trace the case when it was called on for hearing twice before the Court. Therefore, in these circumstances, the warrants were issued for personal appearance.

It is submitted that the respondent has passed the order deciding the representation of the petitioner on 25.11.2016. 3.
After going through the reply and order passed by the respondent, I am not inclined to proceed further in the matter. Therefore, Rule is discharged and the contempt petition is closed, however, with liberty to the petitioner to challenge the order on such ground as may be available to him under the law.
