This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.81 of 2015, registered at Police StationMasturi, District Bilaspur (CG), for the offence punishable under Sections 147, 148, 149, 452, 294, 506-B, 307, 337 and 427 of the IPC. 2.

After hearing learned counsel appearing for the parties and taking into consideration the fact that main allegation against the present applicant is that he has assaulted on the head of Narmada Prasad, in view of the fact that trial is in advance stage, eleven witnesses have already been examined and the case of the present applicant is distinguishable from the other co-accused, this Court is not inclined to release the applicant on regular bail. 3.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
