Learned counsel for the petitioner submits that the Chief Engineer, Public Works Department, Baster-Zone, Jagdalpur, does not have jurisdiction to modify the earlier order passed on 30.07.2016 by him because that order was passed only upon approval of the Minister whereas the modified order has been passed on 05.08.2016.

Despite repeatedly asked, learned counsel for the petitioner submits that the petitioner is not aggrieved by order dated 30.07.2016 (Annexure P/2) which was passed earlier.

The second order passed on 05.08.2016 does not contain any modification of the order of petitioner in so far as his shifting from the office of Executive Engineer, PWD Kanker to Officer of Superintendent Engineer, PWD Kanker Circle Kanker. It appears that the modified order does not at all affect as far as the petitioner is concerned.

It is also found that the petitioner has been only locally shifted and he is not being sent to any other station. The petition appears to be frivolous and is accordingly dismissed with the cost of Rs.500/-. Sd/- (Manindra Mohan Shrivastava) Judge Tiwari
