This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 155/2015, registered at Police Station Kawardha District Kabirdham C.G., for the offence punishable under Section 354 D of I.P.C. & Section 18 of the Protection of the Children from Sexual Offences Act,2012.

Learned counsel for the applicant would submit that jurisdictional police has registered offence under Sections 354 D, 427 of I.P.C. and Section 18 of the Protection of the Children from Sexual Offences Act,2012. He would further submit that all the offences are bailable offences, therefore, bail ought to have granted by jurisdictional Criminal Court. He would lastly submit that Section 18 of the Protection of the Children from Sexual Offences Act, 2012 is also bailable looking to the punishment prescribed under Sections 354 D,
427 of I.P.C.

On the other hand, learned counsel for the State would submit that all the offences charged against the applicant are bailable offences. 4.
I have heard learned counsel appearing for the parties and perused the case diary.

Taking into consideration the submission made by the learned counsel for the parties that all the offences are bailable offences, this Court is of the opinion that present is the fit case, in which, the applicant should be enlarged on regular bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that applicant shall be released on bail on furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
