Even if we were inclined to condone delay in filing application, we do not find any merit in the application because the prosecutrix herself has not supported the case of the prosecution and completely turned hostile. 2.
Though learned State counsel would emphasize upon making report, evidencing some injury on the person of the prosecutrix, in the absence of there being any allegation whatsoever leveled by the prosecution against the accused in the Court evidence, only because certain injury was found on the body of the prosecutrix, it cannot be drawn to a conclusion beyond reasonable doubt that it is the accused, who inflicted such injury. Therefore, the view taken by learned Trial Court is plausible and possible view which does not call for any interference, given the limited scope of interference against the judgment of acquittal. No case is made out for grant of leave to appeal. 3.
Accordingly, CRMP is dismissed.
