This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 17.05.2020 in connection with Crime No.137/2020 registered at Police Station- Shivrinarayan, District Janjgir-Champa for the offence punishable under Section 307, 147, 148, 149 of Indian Penal Code. 2.

As per the prosecution case, on 16.05.2020 the applicant along with other co-accused have assaulted one Swapnil Yadav over the dispute of land and Swapnil was found unconscious on 17.05.2020 and he was admitted to the Hospital.

Learned counsel for the applicant submits that because of the land dispute the entire family of the applicant have been falsely implicated and the applicant being a lady is in jail since seven months and no further evidence is required, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement and the dying declaration of the injured. Considering the dying declaration, I am not inclined to release the applicant on bail. Accordingly, the bail application filed under Section 439 of Cr.P.C. is rejected.
