Mr. Goutam Khetrapal, learned counsel for the petitioner, would submit that though the

letter of intent dated 25.02.2019 (AnnexureP/1) has been issued in favour of the petitioner by the respondent No.1 for the purpose of retail outlet dealership, but the enquiry report prepared by the Patwari for grant of No Objection Certificate (NOC) in this regard is not being submitted by the respondent No.4 before the respondent No.3. In the event of non submission of NOC, the respondent No.1 has issued a letter/show cause notice dated 19.07.2021 (Annexure-P/8) to the petitioner, whereby the retail outlet dealership granted in favour of the petitioner is likely to be withdrawn.

On being asked, Mr. Gagan Tiwari, learned State counsel, would submit that within 2 weeks from today, the necessary decision will be taken qua the application for grant of NOC in favour of the petitioner.

Mr. Sharma, learned counsel for the respondent No.1, would submit that the respondent No.1 will proceed in the matter only after the decision is taken by the State Government qua the petitioner's application for grant of NOC.

The statement made by Mr. Sharma is placed on record.

In that view of the matter, the writ petition is disposed of with a direction to the respondent No.2 to take a decision qua the application for grant of NOC filed by the petitioner within 2 weeks from today and thereafter the respondent No.1 may proceed further in the matter as stated above.
