Proceedings through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 01/10/2020

1. This is the second bail application preferred by the applicant under Section 439 of CrPC for grant of bail, as he is arrested in connection with Crime No.404/2019, registered at Police Station Bhatapara City, Civil/ Revenue Dist. Balodabazar-Bhatapara for the offence punishable under Sections 302, 201, 120B and 34 of the I.P.C. and Section

MCRC No. 6444 of 2020 25, 27 of the Arms Act.

2. Earlier the applicant has preferred first bail application bearing MCRC No.1057 of 2020 in which by order dated 13.07.2020, this Court granted ad-interim bail to the applicant with a direction to surrender before the concerned trial Court on 13.08.2020. In the meanwhile, the matter was listed for final hearing in which by order dated 11.08.2020, the first bail application was rejected on merits, however, the ad-interim bail has been extended till 14.09.2020.

3. Now the applicant has preferred this second bail application along with I.A. No.01/2020, application for extension of temporary bail.

4. Having considered the entire fact situation of the case and considering the fact that there is no change in the circumstances, this Court is not inclined to grant bail to the applicant.

5. Accordingly, this second bail application is rejected. Consequently, I.A. No.01/2020 is also rejected. SD/- (Prashant Kumar Mishra) Judge Ayushi
