1. The applicant has preferred this bail application under Section 438 of Cr.P.C. apprehending his arrest in connection with Crime No.22/2019 registered at Police Station- Benur, Distt-Narayanpur, Chhattisgarh for the offence punishable under Sections 354(A)& 354(B) of IPC.

2. Learned counsel for applicant submits that applicant is innocent and has been falsely implicated in this case. The victim in this case had made a totally false and concocted statement against the applicant and the FIR itself shows, that it is belated by five days. Applicant is a qualified doctor and his future will be compromised if he is arrested and placed in detention., hence, it is prayed that he may be enlarged on anticipatory bail.

3. Learned State counsel opposes bail application and submissions made in this respect. It is submitted that there is direct evidence

Page No.2 present against the applicant regarding outraging the modesty of the victim in this case. Hence, the application be rejected.

4. Heard both the parties and perused the case diary.

5. According to prosecution case, on the date of incident while inspection of the 'Aanganbadi', the applicant finding the victim alone, by use of physical force outraged her modesty and also tried to disrobe her regarding which FIR has been lodged.

6. Looking to the direct statement given by victim of this case under Sections 161 & 164 of CrPC, I do not feel inclined to allow this bail application of the applicant.
