This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 27.05.2020 in connection with Crime No.319/2020 registered at Police Station- Civil Line, District Bilaspur for the offence punishable under Section 307 of Indian Penal Code.

As per the prosecution case, on 14.05.2020 the applicant assaulted one Mukesh which was enough to cause his death and three injuries were inflicted on his forearm, chest and thigh.

Learned counsel for the applicant submits that the injured was admitted to the Hospital only from 14.05.2020 to 19.05.2020, the applicant is in jail since 27.05.2020 and the charge sheet has been filed; therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail and she would submit that as many as 21 past antecedents of the like nature are to the credit of the applicant.

Considering the past antecedents of the applicant and the way the offence has been committed, I am not inclined to release the applicant on bail. Accordingly, the bail application filed under Section 439 of Cr.P.C. is rejected.
