(1) The accused/applicants have moved this bail application under Section 439 of the Code of Criminal Procedure for releasing them on regular bail during trial in connection with Crime No. 102/2015 registered at Police Station Bhatapara (town), Civil & Revenue Distt. Balodabazar-Bhatapara (C.G.) for the offences punishable under Sections 457 & 380 of the Indian Penal Code.

(2) Case of the prosecution, in brief, is that, applicants & other five co-accused persons are alleged to have stolen some dairy milk items & cash amount of 21,000/- from the shop of complainant Arun ₹ Punjabi on 01.05.2015 and thereby committed the aforesaid offences. (3) After hearing learned counsel for the parties and taking into consideration the facts & circumstances of the case, in particular, the stolen articles have been seized from the possession of the applicants; and the other material collected by the prosecution; I am not inclined to release the applicants on bail. Thus, the bail application is rejected. Certified copy as per rules.
