1. Learned counsel for the appellant seeks to withdraw this acquittal appeal with liberty to approach the appropriate appellate forum in view of judgment of this Court in CRMP No.2107 of 2019 decided on 25.09.2019.

2. If the appeal is preferred before the Sessions Court within 30 days from today, the Sessions Court shall hear the appeal on merit without raising objection as to the limitation.

3. Certified copy of the impugned judgment be returned after retaining the photocopy of the same.

4. The appeal is dismissed as withdrawn.
