Writ Appeal No.218 of 2019 challenging the verdict passed by the learned Single Judge in Writ Petition (S) No.1494 to 2019, came to be dismissed by the Division Bench for non-prosecution on 11.04.2019. This is sought to be restored by filing the present MCC.

When the matter came up for consideration before this Court on 13.09.2019, there was no representation on the part of applicant. Though the matter could have been dismissed on that day itself, we decided to grant one more chance and hence, the listing of the matter today. Position continues as before and nobody appears on behalf of the applicant even today. It appears that the applicant has lost interest in the cause of action. 3.
The MCC is dismissed accordingly.
