1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.261/2015 (Criminal Case No.6386/2015 pending in the Court of Chief Judicial Magistrate, Raipur), registered at Police Station Tikarapara, Raipur, for the offence punishable under Section 34 (2) of the Chhattisgarh Excise Act, 1915.

2. Case of the prosecution, in brief, is that 5.4 bulk litres of illicit liquor was seized by the police from the present applicant.

3. I have heard learned counsel for the parties and perused the case diary.

4. Taking into consideration the nature and gravity of offence, the provisions contained in Section 59-A (ii) of the Chhattisgarh Excise Act, 1915, and considering several criminal antecedents of the applicant, I am not inclined to grant regular bail to the applicant.
