Hon'ble Shri Justice Rajendra Chandra Singh Samant Order On Board 06/10/2021 Heard.

1. This petition under Article 227 of the Constitution of India has been brought seeking issuance of direction on the ground of inaction of the Court concerned.

2. The charge-sheet has been filed against the private respondents on 29.6.2017 for their prosecution for commission of offence under Sections 294, 323, 336, 506, 34 of IPC, which is pending till date even the charges have not been framed so far. It is submitted by the counsel

for petitioner that petitioner is complainant in that case and one application under Section 302 of CrPC has been filed seeking permission to assist the Prosecution Officer, which has also not been considered and decided so far.

3. Considering that the proceeding in the Criminal Case No.4830/2017 is almost stand still without any progress, hence, the petition is disposed off at motion stage. The learned trial Court is directed to proceed expeditiously by considering and deciding the application filed by the petitioner and then consider on framing of charges against the private respondents. In case the respondents are charged then the trial Court is also directed that trial in the case may also be taken up expeditiously.
