The present petition has been filed under Section 378 (3) of the Cr.P.C. seeking leave to file acquittal appeal. Counsel for the appellant submits that the acquittal appeal preferred by the State has already been admitted and the number of the said appeal is 70/2017.

Considering the facts and circumstance of the case, leave as prayed for is granted.

Office is directed to registered the present case under the head acquittal appeal.

Acquittal appeal is admitted for hearing.

As all the respondents are already represented, the appellant is not required to pay separate processes fee.

List this appeal for final hearing along with Acquittal Appeal No. 70/2017 in due course.
