Heard on I.A. No.01 for condonation of delay in filing the MCC.

For the reasons assigned in the said application and finding them to be satisfactory, I.A. No.01 is allowed and the delay of 331 days in filing the MCC stands condoned. Also heard the MCC.

It has been preferred seeking for restoration of W.P. No. 712/2001 which got dismissed on 07.12.2015 for want of prosecution.

Consideration the total facts and circumstances of the case particularly the nature of dispute raised by the petitioner in the writ petition and also taking into consideration the reasons assigned for the default of appearance on the part of the petitioner on the date when the matter was listed on 07.12.2015, this Court is of the opinion that it is a fit case to allow the application for restoration of W.P. No. 712/2001. Accordingly, the present MCC is allowed and W.P. No. 712/2001 is restored to its original number.

No order as to costs.
