(1) This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with crime No.142/2014 registered at Police Station Baramkela, District Raigarh, for the offences punishable under Sections 365 & 394/34 of the Indian Penal Code. (2) Case of the prosecution, in brief, is that on 21.11.2014 applicant & other co-accused persons are said to have robbed the Truck bearing registration No. OR 19 N 3777 owned by

victim/complainant and thereby committed the aforesaid offences. (3) Counsel for the applicant submits that the applicant has not committed any offence and he has falsely implicated in the offence in question as the supplementary charge sheet has already been filed against the applicant and, as such, he is in jail since 19.06.2015 and, therefore, the applicant may be released on bail.

(4) On the other hand, counsel for the State opposes the bail application.

(5) Taking into consideration the facts & circumstances of the case and the manner in which the truck in question is said to have been looted by the applicant along with other co-accused persons, I am not inclined to release the applicant on bail. Thus, the bail application is rejected.
