1. Heard.

2. Learned counsel for the petitioner submits that a permit was granted to respondent No.3 on 01.02.2018 and the said order of grant contains that in respect of the timing, if certain objections are preferred within a period of 3 months, the said timing would be interchangeable, after the hearing is made. He would further submit that pursuant to the order of grant of permit, which

reserves the right to raise objection, an objection was made by the petitioner on 21.02.2018 vide Annexure P-3, which was submitted to the respondent, however, the same is not been decided till date.

3. Perused the order of grant of permit dated 01.02.2018 which contains the right of objection to the aggrieved party within a period of three months. The petitioner claimed that he was the aggrieved party and as per Annexure P-3 it appears that the objection was made with respect to the timing which was submitted on 21.02.2018, therefore, under the facts of this case, it is directed that if the objection is not decided till date, the State authorities shall decide the same within a further period of 45 days from the date of receipt of copy of this order, wherein all the respective parties shall be heard before the orders are passed.

4. With the aforesaid observation, the writ petition stands disposed of. Sd/- Goutam Bhaduri Judge Ashu
