(1) The accused/applicant has moved this Second bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 114/2014 registered at Police Station Chhuikhadan, Distt. Rajnandgaon for the offences punishable under Sections 363,366 & 376 read with Section 34 of the Indian Penal Code and Sections 4 & 6 of the Prevention of Children from Sexual Offences Act, 2012.

(2) The applicant's first bail application was dismissed as withdrawn by order of this Court dated 17.03.2015 passed in M.Cr.C. No.

1148/2015 with liberty to repeat the same after examination of the material prosecution witnesses.

(3) The second bail application has been filed by the applicant on the strength of statement of prosecutrix & her father whereas other material prosecution witnesses are yet to be examined. (4) Accordingly, the second bail application is dismissed reserving the liberty to file afresh after other material witnesses are examined. Certified copy, as per rules.
