The grievance of the petitioner in the instant case, though the respondent No. 3 has placed the petitioner under suspension from 23.07.2016 but till date the departmental enquiry is not initiated against the petitioner.

According to the petitioner, he was served with a charge-sheet dated 03.09.2016 to which the petitioner had submitted his reply on 03.10.2016 thereafter there has been no further development on the issue.

Without entering into the merit of the case, since the petitioner is under suspension for more than about 3 years by now and the departmental enquiry has not been initiated by the department, this
-2Court is of the opinion that ends of justice would meet if the writ petition is disposed of with a directions to the respondent No. 3 to reconsider the order of suspension of the petitioner. 4.
While reconsidering the case of the petitioner for revocation of suspension, the authority would also take note of the issue of the Supreme Court in the case of Ajay Kumar Choudhary Vs. Union of India & Anr. 2015 (7) SCC 291. It is expected that the respondent No. 03 would take an appropriate decision within a period of 60 days from the date of receipt of copy of this order passed by this Court is concerned.
