This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 10.08.2020 in connection with Crime No. 230/2020 registered at Police Station Kondagaon for the offence punishable under Section 306 of Indian Penal Code.

As per the prosecution case, one Ramsheela Yadav committed suicide by consuming poison and eventually died on 24.05.2019 and the applicant subsequently is arrested after lodging of the FIR on 06.08.2020. 3.

Learned counsel for the applicant submits that initially the FIR was not registered and the statement of the witness would show there is no allegation attributed to the applicant and subsequently after a gap of one year the FIR has been registered and no abetment for suicide is made out against the applicant.

Per contra, learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the merg statement of Jayanti Yadav, Pardeshi Yadav, Lal Singh Markam, Puran Singh, Raju Ram and others were

perused. Taking into such statement and considering the fact that the charge sheet has been filed, I am inclined to release the applicant on bail. 6.

Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
