1. The accused/applicant has moved this second bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 03/2019 registered at Police Station Torwa, Bilaspur for the offence punishable under Section 307, 294, 506 B, 323, 147, 148, 149 of Cr.P.C. read with Sections 25 and 27 of the Arms Act.
2. First bail application moved by the applicant was dismissed by the order passed by this Court on 20/05/2019.
3. At the outset, learned counsel for the applicant submits that the trial Court be directed that if the applicant i.e. accused surrenders, his application for regular bail will be considered preferably on the same day or on the next day.
4. Prayer made by learned counsel for the applicant is fair and reasonable. If the applicant surrenders, the trial Court is directed to
consider the regular bail application moved by the applicant preferably on the same day or on the next day accordingly.
