1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.107/2014 {ST No.41/2015 pending in the Court of Additional Sessions Judge (FTC), Ambikapur}, registered at Police Station Udaypur, Distt. Surguja, for the offence punishable under Section 376 of the IPC.
2. After hearing counsel for the parties, taking into consideration the manner in which the applicant is alleged to have committed sexual intercourse with the prosecutrix on 5-10-2014 which is promptly reported on 5-102014 itself and the material collected by the prosecution and available in the case diary, I do not consider it a fit case for grant of regular bail to the applicant. The application is rejected.
