1. Learned counsel for the petitioner would submit that he may be permitted to withdraw this writ petition (Criminal) pursuant to the return filed by the petitioner. He further submits that he may be given liberty to raise all the objections, which have been raised in this petition, before the Trial Court.

2. The submission made by learned counsel for the petitioner is vehemently objected by the State Counsel.

3. It is right of the accused/petitioner/s to raise the objections whatever they want to raise before the competent Court of jurisdiction where the trial is pending.

4. Accordingly, the writ petition is dismissed as withdrawn with the liberty granted in favour of the petitioner to raise all objection before the trial Court where the matter is pending consideration. Sd- (Narendra Kumar Vyas) Judge amita
