This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.33/2014, registered at Police Station-Patna, District Korea (CG), for the offence punishable under Sections 457 and 380/34 of the IPC.

Taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence, also considering the fact that the applicant is alleged to have stolen a sum of Rs.40,000/- from the shop of the complainant and his criminal antecedents, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
