1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 130/2018 registered at Police Station City Kotwali, District Dhamtari (C.G) for the offences punishable u/ss 420, 120B, 467, 468 of IPC and sections 4, 5 & 6 of Prize Chits and Money Circulation Scheme Act.

2. As per the prosecution case, the applicant allured the general people at large to invest the money in the Company namely Susk India Limited with an assurance to get the amounts doubled. Thereafter when the maturity was due, the Company was closed. Learned counsel for the applicant would submit that the applicant is in jail since 15.02.2017 and has been arrested in different crime. He further submits that similarly placed accused has been enlarged on bail by the coordinate Bench of this Court and by now, the charge

sheet has been filed and no further investigation is necessary, therefore, he may be enlarged on bail.

3. On the other hand, learned State Counsel opposes the prayer for grant of bail.

4. Considering the fact that the applicant is in jail since 15.02.2017 and the charge sheet has been filed in this case, I am inclined to allow this bail application.

5. Accordingly, this application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed.
