The applicant has preferred this application for grant of bail as he is arrested in connection with Crime 129/2020 registered in Police Station Patewa, District Mahasamund (C.G.) for offence punishable under sections 307, 458 of Indian Penal Code.

As per the prosecution case, on the date of incident on 3/07/2020 in the intervening night of 4/07/2020 the applicant came with axe and assaulted the injured Chandrahas whereby he suffered a injury at left cheek and thereafter the applicant ran away.

Learned counsel for the applicant submits that there was no intention to kill and the applicant himself is physically handicapped and the injury is also not fatal. He is in jail since 25th August, 2020, therefore the applicant may be released on bail.

Learned State counsel opposes the bail application. 5.

Perused the statement of the injured and the medical report. Considering the facts and circumstances and the applicant is in jail since 25th August, 2020, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
