The applicant is apprehending his arrest in connection with Crime No.287/15 registered at police station - Dongargarh, Distt- Rajnandgaon, CG for alleged commission of offence under Section 34 (2) of the CG Excise Act. 2.
Prosecution case is that the applicant is involved in illegal transportation of huge quantity of liquor without any authority of law. 3.
Learned counsel for the applicant submits that the applicant is being falsely implicated at the instance of the police persons. He submits that the so called witness along with the police team, chasing vehicle containing liquor are not reliable and it is not known how they knew that the applicant will be found with liquor. 4.
On the other hand, learned State counsel submits that there are two independent persons who had gone along with the police trap team to intercept the vehicle carrying liquor and the applicant is one, who was found sitting in the vehicle. 5.
Considering the aforesaid submission, I am not inclined to grant bail to the applicant. The application is therefore rejected. Sd/- Manindra Mohan Shrivastava Judge Deepti
