1. Heard.

2. The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.96/2020, registered at Police Station Sargaon, District Mungeli (CG), for the offence punishable under Sections 457 & 380 of the Indian Penal Code.

3. Applicant along with co-accused Rewaram Sahu & Ripusudan Sahu @ Sonu committed theft of cash of Rs.9,000/-, silver ornaments and mobile phone, total valued at

Rs.22,000/- from the house of the complainant during the intervening night of 28th/29th April, 2020.

4. Admittedly, co-accused Rewaram Sahu & Ripusudan Sahu @ Sonu have been enlarged on regular bail vide order dated 31-8-2020 passed in M.Cr.C.No.4197 of 2020.

5. The present applicant is in jail since 14-5-2020 and the charge sheet has already been filed, therefore, considering all the relevant aspects of the matter, I am of the opinion that present is a fit case to release the applicant on regular bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
